Fenton Prize Draw T&Cs
1. THE PROMOTER
The promoter is L Lambert Holdings Ltd (“Promoter”) of 411-413 Oxford Street, Mayfair, W1C 2PE, UK.
2. THE PRIZE DRAW
The title of the prize draw is the Fenton Prize Draw (“Prize Draw”).
3. HOW TO ENTER
3.1 No purchase is necessary to enter the Prize Draw.
3.2 The Prize Draw will run from the time and date specified in the relevant Prize Draw announcement post on Instagram or other relevant channel(s) (the “Prize Draw Announcement”) (the “Opening Date”) to the time and date specified in the Prize Draw Announcement (the “Closing Date”) inclusive (“Prize Draw Period”).
Alternatively, if the Prize Draw is stated to run monthly (on a recurring basis) in the relevant Prize Draw Announcement: the Prize Draw will run monthly from the date of the relevant Prize Draw Announcement, inclusive (the “Opening Date”), until the same day as the Opening Date in the next relevant month, exclusive of that day (the “Closing Date”) (each such monthly period, a “Prize Draw Period”). For example, if the Opening Date is on 20th March 2019, the Prize Draw Period will be from 20th March 2019 until 19th April 2019 (inclusive).
3.3 Entries must be made during the Prize Draw Period and following (one of) the method(s) set out in section 3.4 or 3.5 and/or as further set out in the relevant Prize Draw Announcement.
3.4 In order to enter the Prize Draw through the Fenton Instagram account @fentonandco, if applicable to the Prize Draw you are participating in, you must:
a) follow @fentonandco on Instagram; and
b) comply with any further conditions which may be specified in the relevant Prize Draw Announcement.
3.5 In order to enter the Prize Draw through the Fenton website located at www.fentonand.co, if applicable to the Prize Draw you are participating in, you must:
a) connect to our website located at www.fentonand.co and follow any applicable instructions set out therein; and
b) comply with any further conditions which may be specified in the relevant Prize Draw Announcement.
3.6 The Promoter will not accept:
a) responsibility for Prize Draw entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any lack of internet connectivity, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
b) proof of transmission as proof of receipt of entry to the Prize Draw.
3.7 By submitting a Prize Draw entry, you agree to be bound by these terms and conditions.
4. ELIGIBILITY
4.1 The Prize Draw is only open to all residents in the United Kingdom aged 18 years or over, except:
a) employees of the Promoter or its holding or subsidiary companies;
b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Prize Draw or its administration; or
c) members of the immediate families or households of (a) and (b) above.
4.2 By entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promoter may require you to provide reasonable proof that you are eligible to enter the Prize Draw.
4.3 The Promoter will not accept Prize Draw entries that are:
a) automatically generated by computer;
b) completed by third parties or in bulk;
c) illegible, have been altered, reconstructed, forged or tampered with;
d) photocopies and not originals;
e) incomplete; or
f) otherwise intended to disrupt the normal administration of the Prize Draw.
5. THE PRIZE
5.1 The Prize is a Fenton ring as further stated in the relevant Prize Draw Announcement (the “Prize”).
5.2 A total of one (1) Prize will be awarded in each Prize Draw Period, unless otherwise specified in the relevant Prize Draw Announcement.
5.3 In the event that any Prize is unavailable, Promoter will substitute it for a prize of equal or greater value. There is no cash alternative for the Prize(s).
5.4 Prize is an East-West ring in aquamarine or garnet in our original size. Entries open from 13.03.2020 until 20.03.2020. Possibility to use the prize as a £1,750 credit towards another design and/or a bigger size. No refunds will be given. Winner will also win a complimentary SUITCASE subscription!
6 WINNER ANNOUNCEMENT
6.1 Prizes will be awarded at a random drawing to be held on the date specified in the relevant Prize Draw Announcement. The winner of the Prize Draw will be notified via the channel he/she used to enter the Prize Draw within two (2) business days of the draw (“Announcement Time”).
6.2 The decision of the Promoter is final and no correspondence or discussion will be entered into.
6.3 The Promoter will send the name and country of each of the winner to anyone who emails concierge@fentonand.co within one (1) month of the Closing Date, requesting details of the winner(s).
7. CLAIMING THE PRIZE
7.1 The Promoter will make all reasonable efforts to contact the winner. If you are a winner of the Prize Draw, you will have five days from the Announcement Time to claim the Prize by responding to the method by which you are contacted at Announcement Time. If you do not claim the Prize by this time, your claim to the Prize will become invalid and an alternative winner will be selected by repeating the process outlined in section 6.1.
7.2 If a winner does not meet the eligibility criteria, his/her claim to the Prize will become invalid and an alternate winner will be selected.
7.3 The Prize may not be claimed by a third party on your behalf.
7.4 The Promoter does not accept any responsibility if you are not able to take up the Prize in accordance with the requirements outlined above.
8. LIMITATION OF LIABILITY
8.1 Insofar as is permitted by law, the Promoter, any third party that directed you to this Prize Draw, their respective agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by their respective negligence or that of their employees. Your statutory rights are not affected.
8.2 If you participated in this Prize Draw through instructions and/or recommendations of a third party that directed you to it (other than the Promoter), please note that this third party does not run, and is not responsible or liable for, the provision of this Prize Draw. Any issue or concern you may have, arising out of your participation in the Prize Draw, should be brought to the attention of the Promoter by emailing: concierge@fentonand.co.
9. DATA PROTECTION AND PUBLICITY
9.1 If you are a winner of the Prize Draw, you acknowledge that the Promoter may use your name, image and town or county of residence to announce you as a winner of this Prize Draw.
9.2 Subject to sections 9.1, all personal data submitted to the Promoter in connection with this Prize Draw will be treated in accordance with the Fenton Privacy Policy.
10. GENERAL
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Prize Draw.
10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize Draw where it becomes necessary to do so due to unforeseen reasons outside of Promoter’s reasonable control.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
